Philippines and Germany conclude final round of negotiations on a new Double Taxation Agreement

The Philippines and Germany concluded the third and final round of negotiations on the revision of the Agreement for the Avoidance of Double Taxation with respect to Taxes on Income and Capital on 20 July 2012 at the Germany Federal Ministry of Finance in Berlin.

The new tax treaty is designed to protect against the risk of double taxation where the same income is taxable in the Philippines and Germany. It is also aimed at preventing fiscal evasion and fostering cooperation between Philippine and other tax authorities by enforcing their respective tax laws. An effective international tax treaty is expected to facilitate trade and investments.

“This new tax treaty will provide German investors with certainty and guarantees in the area of taxation,” Ambassador Maria Cleofe R. Natividad reported after the successful completion of the negotiations on a new bilateral tax treaty with Germany. “It will bolster our economic diplomacy efforts here in Germany.”

Commisioner Kim S. Jacinto-Henares of the Bureau of Internal Revenue (BIR) headed the Philippine delegation during the negotiations. The other members of the delegation from Manila were Undersecretary Carlo Carag of the Department of Finance, Assistant Commissioner Marissa Cabreros of the BIR, Atty. Charadine Bandon of the BIR International Tax Division, and Director Mersole Mellejor of the Department of Foreign Affairs.

Ambassador Maria Cleofe R. Natividad represented the Philippine Embassy during the negotiations. She was joined by Third Secretary Azela Arumpac and Finance Attache Generosa Balocating. The Embassy provided crucial support during the five-day negotiations.

The German delegation was headed by Dr. Wolfgang Lasars of the Federal Ministry of Finance. He was assisted by Ms. Simone Richter, a senior tax expert from the same Ministry, and Mr. Heinz-Josef Johansmeier, a legal expert from the Federal Foreign Office (FFO), Mr. Sven Green (FFO) and Ms. Nadine Lichtblau of the Federal Ministry of Economy and Technology.

All outstanding issues were resolved during the last round of negotiations, with both parties agreeing on the adoption of new standards in the tax treaty.

During the course of negotiations, the Philippine and German delegations agreed to ensure early completion of their respective domestic requirements for the ratification of the new treaty. The signing of the new agreement is expected to take place in Germany early next year.

Germany is a significant economic partner of the Philippines. From January to November 2011, total trade was valued at USD2.9 billion, with Germany as the biggest export market for Philippine goods in Europe. German companies in the Philippines include Continental Temic, Siemens, Lufthansa Technik, Daimler Benz, BMW, Bayer, and Bosch. – END

Philippine Embassy Berlin supports Bonn Conference on Vocational Training and Skills Development in the Philippines

The Philippine Embassy in Berlin supported the conference on “Development Cooperation with the Private Sector in Vocational Training and Skills Development in the Philippines” on 09 July 2012 in Bonn, Germany.

The one-day conference was organized by the Don Bosco Mondo e.V., the Federation of Catholic Entrepreneurs BKU, and the AFOS Foundation for Entrepreneurial Development Cooperation, in cooperation with the German Agency for International Cooperation (GIZ GmbH), with the support of the Bank im Bistum Essen eG and the Embassy.

The conference gathered experts from the private sector in the Philippines to dialogue with German experts on technical and vocational education and training (TVET). The discussions touched on various aspects of introducing an effective and sustainable vocational education program in the Philippines, whose graduates possess the right skills and competencies needed by the business sector, especially in the light of the country’s ongoing K to 12 educational reform program.

Mr. Tom Pätz, Managing Director of GIZ, Ms. Kathrin Oellers of the Federal Ministry for Economic Cooperation and Development (BMZ) and Minister Mardomel Melicor of the Embassy welcomed the experts and participants to the conference. The latter emphasized the Embassy’s keen interest in enhancing vocational education in the Philippines and its full support for the conference.

Dr. Isagani R. Cruz, President of Manila Times College and Curriculum Adviser of the Steering Committee on the K to 12 Educational Reform Program, and Fr. Dr. Dionisio M. Miranda, President of the University of San Carlos, provided an overview of the Philippine education reform, and the efforts of private universities to provide vocational and business experience to their college students.

Mr. Gerry Sta. Ana and Mr. Philip N. Tan, representing the private sector and the chambers of commerce and industry, outlined their experiences in Cebu in initiating and sustaining vocational programs that are tailor-fitted to the changing needs of the business sector.

Dr. Torsten Klavs of F. Porsche AG shared the successful experience in vocational training the Porsche Training and Recruitment Center Asia (PTRCA) in Makati. PTRCA operates a world class training program for Porsche mechanics in cooperation with the Don Bosco Technical Institute and PGA Cars.

It is the first Porsche training facility of its kind outside Germany, and its graduates meet all the skills and qualifications of a Porsche mechatronic automobile serviceman. Almost all graduates of PTRCA have been absorbed in Porsche maintenance facilities all over the world. So successful is the program that the German automobile manufacturer plans to open similar training centers in two other countries.

The private sector has a crucial role to play in putting vocational education in the mainstream of Philippine education. The German experience shows that the private sector must take the lead, actively set the curriculum and be at the forefront in the testing and certification of graduates.

To what extent elements of the highly acclaimed German dual system can be adapted to the Philippine setting, and what the roles of government agencies, certification bodies and civil society shall be, need careful reflection and study. Furthermore, public perception and social acceptance of TVET has to become more positive.

The participants were convinced that vocational training and skills development can be a field for innovative forms of development cooperation between the Philippines and Germany.

In Cebu, the AFOS Foundation for Entrepreneurial Development Cooperation of the Federation of Catholic Entrepreneurs BKU cooperates closely with the Cebu Chamber of Commerce and Industry (CCCI) and the University of San Carlos in various development projects. In the WE CAN – Visayas & Caraga project, AFOS partners with CCCI in providing support for trade and industry in selected areas in the Visayas and the Caraga regions. (END)

GIZ Workshop to Forge Cooperation on Biomass and Biogas Projects in the Philippines

The GIZ, or the Deutsche Gesellschaft fur Internationale Zusammenarbeit, conducted on 28 June 2012 a one-day workshop on “Energy from Biomass and Biogas in the Philippines“.

The workshop sought to familiarize German renewable energy companies on the challenges and opportunities in the biogas and biomass industry of the Philippines. Twenty five entrepreneurs and consultants from the German biogas, biomass, and biofuel sectors attended the workshop to listen to market entry conditions and project opportunities in the Philippines.

Speakers from the Philippines included Mr. Albert Dalusung, Vice President of the Biomass Renewable Energy Alliance, who shared information on potential cooperation partners and current bioenergy projects in the Philippines. Mr. Dalusung informed German investors that local governments are particularly supportive of biogas / solid biomass electricity generation, especially in municipalities where there are abundant biomass feedstock and animal waste for biogas.

The other speaker was Mr. Paul Thomas Puthenpurekal, President and COO of Solutions Using Renewable Energy (SURE) Inc., who shared his experiences on how biogas projects are managed in the Philippines, as well as the demand for biomass/biogas technology in the country. His company, SURE Inc., has vast experience as a renewable power project developer in Southeast Asia.

Though the Philippines remains highly dependent on fossil fuels for its energy supply, there is now a growing local interest to pursue renewable sources of energy not just as a sustainable energy alternative, but also as a potential source for job creation in the Philippine countryside. In the area of bioenergy, there are very good opportunities to build business partnerships between foreign and local partners in the Philippines that cover the entire value chain for the production and distribution of energy from biogas and biomass.

The German Federal Ministry of Economics and Technology (BMWi) and its operational arm, the GIZ, has been working closely with local agencies and the private sector in promoting development cooperation in the Philippines.

The GIZ operates on behalf of the BMWi, as well as other German ministries such as the Federal Foreign Office, the Federal Ministry for Economic Cooperation and Development and the Federal Ministry for the Environment, in developing markets and in setting up structures and developing capacity for good governance with partner countries such as the Philippines.

The Philippine Embassy in Berlin has been working closely with the GIZ and concerned federal ministries, as well as with the European Chamber of Commerce of the Phiilppines and the German-Philippines Chamber of Commerce and Industry, Inc. in pursuing business matching opportunities as well as to ensure that the Biomass Renewable Energy Alliance and other Philippine-based company representatives are able to learn more about German products and services, and the overall energy policy environment in Germany.
